In the course of doing business, Microsystems receives documents from customers and prospective customers for the purpose of 1) configuring the solution (product) for the customer’s or prospective customer’s environment or 2) document repair or cleanup. Microsystems does not own or control any of the information it processes on behalf of its customers or prospective customers. All such information is owned and controlled by Microsystems’ customer. In this capacity, Microsystems receives information transferred from the EU to the United States merely as a processor on behalf. When acting as a Processor on Behalf, concerning personal information that has been transferred from the EU to the United States, Microsystems has in place measures to protect personal information from loss, misuse, unauthorized access, disclosure, alteration and destruction. Personal Data Collection – Microsystems collects information about its customers and prospective customers for the purpose of facilitating business relationships, correspondence and communication. In this business context, Microsystems provides access to product information, educational webinars, marketing updates and industry information. It is through this regular communication Microsystems is able to provide valuable information about important issues related to our customers’ key work product—their documents. Microsystems will provide timely and appropriate notice describing the personal information being collected, how the information will be used and with whom that information may be shared. As a general practice, name, and business information including address, phone number, email address and employment information are the only personal information items collected. ChoiceMicrosystems will offer individuals the opportunity to choose (opt out) whether their personal information is to be used for any other purpose other than what it was collected for, namely, ongoing business communications related to document production and maintenance and the use of Microsystems’ products. Microsystems, upon request, will remove an individual’s name and related information from all communication lists. Onward TransfersMicrosystems requires all agents who perform processing tasks on behalf of and under the instruction of Microsystems require its agents to either: Subscribe to the EU Safe Harbor or enter into a written agreement with Microsystems requiring them to provide the same level of protection as Microsystems. SecurityMicrosystems has technological and operational security processes designed to protect personally identifiable information from loss, misuse, alteration or destruction. Only authorized employees have access to any data provided by you, and that access is limited by need. Each employee having access to any personally-identifiable information is obligated to maintain its confidentiality. Although we take steps that are generally accepted as industry standard to protect your personally-identifiable information, we cannot guarantee that your personally-identifiable information will not become accessible to unauthorized persons. Microsystems also provides security for clients who wish to upload documents to our website; this is frequently done for clients who submit documents for either a Document ER request to our Solutions Center or a Migrations Services project. Clients are able to transfer documents to/from their account to our server by connecting to their Microsystems account using a SSH protocol (Secure Shell). The account consists of a username, password, and all data associated with the client, which are encrypted during transmission. The client account is only accessible to the client and appropriate Microsystems personnel who are responsible for maintaining client files. TransferCustomers and prospective customers may send documents to Microsystems team via regular e-mail, TLS-encrypted e-mail, SSL-encrypted Secure File Transfer server or by upload to our SSH server. StorageDocuments are stored in a secure network location. DeletionMicrosystems deletes any client documents that are considered unusable, unnecessary or invalid. All customer and prospective customer documents are deleted 90 days after the project has been completed or after the associated issue has been closed. Data IntegrityMicrosystems will use data consistent with the Principles. Personal information collected must be relevant for the purposes for which it will be used. To the extent necessary for those purposes, Microsystems will take reasonable steps to ensure that personal information is accurate, complete, current and reliable for its intended use. AccessMicrosystems will allow individuals to access their personal information. Further, Microsystems will allow the individual to correct, update, or delete information. Microsystems EnforcementMicrosystems uses a self assessment approach to ensure compliance with this policy. This includes a periodic assessment to assure the policy is accurate and adhered to throughout the organization. If an individual has concerns, the contact information above can be used to raise those concerns and Microsystems will investigate and attempt to resolve any complaints and disputes regarding use and disclosure of personal information in accordance with the Principles. Filing a complaint in English will expedite the process.
